However, professional lawyers and legal consultants are private entities, but they can help to reduce the disputes or to resolve the employment disputes. They help not less than but end of service benefits, immigration issues, court cases and more. Therefore, professional lawyers and legal consultants are helpful in employment matters including editable salary subjects.

The concept of equal pay is widely applicable around the world in many developed nations, which has recently been introduced in the UAE. Its emphasis is based on incorporating modern and employment practices across the Emirates of UAE. Modern employment approaches and rules are being implemented across the Emirates.

UAE government has taken useful steps to make sure every employee gets fair compensation against their service provision. It also curbs discrimination based on gender, ethnicity, and background. If the people have some disputes or disagreement, then we suggest they must escalate for professional legal advice first.

Rules and Regulation governing Equal Salary Laws:

The UAE has been making countless efforts to bring the UAE vision into practicality. Therefore, the New Salary law was passed to bring in equality in the labor market.

UAE Decree Law: Federal Decree Law 33 of 2021:

UAE labor law has been subject to evolution to bring about change. This equal pay law has become a crucial part of Federal Decree-Law No. 33 of 2021 on Labor Relations.

The new UAE labor law elaborates that every female worker should receive equal pay to male workers who are performing similar work.

The rule is evenly applied across all private sector entities in the UAE. Now the employer is bound to design the salary package based on the equality of gender.

UAE Vision for Future Betterment:

The government has introduced the legal provision under which wage equality has become an official part of the law. The employers are bound to adhere to the law and offer equal pay to workers.

This approach is in line with the international standards and Human Rights protocols. The prime intention is to protect the rights of employees, and it also promotes a transparent and balanced working environment.

No More Gender-Based Discrimination:

The law of equal pay for men and women was introduced to end the disparity because of gender or sex of the worker.  It has become a part of the UAE labor law, which stamps its existence.

The Goals for Equal Salary Law across the Emirates: Private Sector

The key objective of equal salary for all workers in the private sector is to eliminate all kinds of discrimination, differences, and disparities in the workplace. It promotes a high level of fairness and wage equality in the UAE, which was not the case before.

Basic salary is based on factors such as skills and expertise. However, it also accounts for factors like qualification, experience, and performance. Gender, color, class, creed, and race are not taken into consideration to decide on the Salary.

This brings in more cultural and ethnic diversity in the UAE marketplace. Additionally, it also offers job security to the expats working in the UAE. This will bring equilibrium in the workforce, and cultural differences will be wiped out.  Gender equality in the workplace will allow women to actively participate in the workplace.

Improve Corporate Reputation

It is a way to improve corporate reputation and goodwill. The employers who are actively adopting this will have been fulfilling their corporate social responsibility, contributing to the overall society.

Fair Pay Practice: Beneficial For Employees and Employers

The fair pay practice will lead to a conducive and productive work environment in the UAE that benefits employees and employers alike. It garners reputation and goodwill for the entrepreneurs. As a result, employees will have better motivation and improved morale to work dedicatedly. It also contributes to improved productivity levels for the workers at work.

Application of Equal Salary Law in the UAE:

This new rule is applicable to the private sector corporations and entities across the Emirates.  It is evenly applied to various prominent sectors like finance, legal, technology, healthcare, retail, banking, and others.

It is evenly applied to all kinds of workers, such as full-time workers, part-time employees, and even to contractual labor in the UAE. As a result, employers now need to revise the compensation structure or bring equality and ensure compliance with the New UAE Labor Law.

The Rights of Employees in Equal Pay Law:

With the introduction of equal pay, workers enjoy greater legal protection and legal rights. Now the employees in the UAE will get fair and equitable compensation for their services. The workers in the UAE will feel valued, motivated, and dignified. The new UAE labor law safeguards workers against discriminatory practices and prevents retaliation in the workplace.

However, if an employee feels left out or feel is not paid fairly, he can launch a legal complaint. UAE Workers can easily choose to register the complaint with the Ministry of Human Resources and Emiratization (MOHRE).

The Role of the Employer in Enforcing Equal Pay in the UAE:

The employer is the main individual behind the application of the law. This will bring significant alterations to the existing employment agreements.

It will also change the current payroll structure for their workers. Therefore, the employer will be revising the current policies. It is mandatory to ensure compliance with the new equal pay rule in the UAE.

The employer follows the concept of the new equal salary law to bring in fairness and a transparent pay structure for its workers.

This new law paves the way for avoiding discriminatory practices in the workplace, which may trigger penalties. Now, the employee needs careful consideration while redesigning the new payroll system. They will consider the qualifications, experience, and responsibilities, but it will make the policy transparent and fair.

Equal Pay and the Role of MOHRE:

MOHRE is a regulatory authority operating inside the UAE that handles all employee and employee-related issues and can closely monitor compliance with UAE labor law. In this, they will check that organizations in the private sector adhere to the new equal salary law. They will play an active part in implementing the concept of equal pay across the Emirates.
